East Circuit (3.93 km) The most intense layout with minimal straights and blind corners, raced on by Cafnix and used for private events. West Circuit (3.41 km) The most condensed layout generating incredible wheel-to-wheel action, raced on by GT World Challenge and TCR Australia, and used for The Bend Experience Program. Terms and Conditions 1. The Bend Motorsport Park Pty Ltd (ACN 609 932 685) (TBMP) is the sole legal and beneficial owner of all intellectual property rights in the Simulation, and your purchase of the Simulation does not operate to assign any of TBMP’s intellectual property rights in the Simulation to you. 2. In consideration for you paying the price for the Simulation set by TBMP on its website at the time of purchase, TBMP grants you a single, limited, non-exclusive licence to use the Simulation for recreational or training purposes. 3. The Licence is personal to you and must not be transferred or assigned to any third party without TBMP’s prior written consent. 4. Except as expressly authorized by TBMP, You must not: 4.1. copy, reproduce, modify, sell, rent, lease, distribute, mirror, republish, download, transmit, or create derivative works of the Simulation, in whole or in part, by any means; 4.2. sublicense the Simulation to any third party; 4.3. modify, decompile, or reverse engineer the Simulation; 4.4. remove or modify any copyright or trademark notice, or other notice of TBMP’s ownership of the Simulation. 5. To the maximum extent permitted by law: 5.1. All guarantees, warranties and representations in respect of the Simulation are expressly excluded, and without limiting this paragraph, TBMP makes no warranty as to: (a) the completeness or correctness of the Simulation; (b) that the Simulation is fit for your intended purpose; or (c) that the Simulation is free from defects or viruses. 5.2. TBMP’s sole liability to you in respect of the Simulation is limited to (at TBMP’s option): (a) repair or replacement of the Simulation; or (b) payment of the cost of resupplying the Simulation to you. 6. Paragraph 5 above does not exclude, restrict or modify the application of any guarantee, right or remedy which cannot be excluded by law, including any rights under the Australian Consumer Law. Goods come with guarantees, including a guarantee that those goods are of acceptable quality. If there is a failure of this guarantee, You are entitled to a remedy (which may include having the goods repaired or replaced, or a refund). If a repair or replacement cannot be provided or there is a major failure, You are entitled to a refund. 7. TBMP may, but without any obligation whatsoever, offer upgrades or bug fixes for the Simulation from time to time and may charge a fee for the same at its sole discretion. 8. You will notify TBMP immediately if You become aware that any third party is infringing TBMP’s intellectual property rights in the Simulation.
